Terms of Service

1. Agreement

These terms govern the use of Exylia Licenses (the "Service"): the panel at licenses.exylia.net and the Exylia Discord bot. They also set out the license for the Minecraft plugins sold by Exylia, their loaders and their updates (the "Software"). The Service and the Software are provided by Cristobal Aranda, a natural person domiciled in Chile ("we", "us"). Contact: [email protected].

By signing in, using the bot, or downloading, installing or running the Software you accept these terms. If you act on behalf of a server, network or organisation, you confirm that you are authorised to bind it; "you" then also means that organisation. If you do not accept them, do not use the Service or the Software.

2. Purchases on BuiltByBit

The Software is sold on BuiltByBit (builtbybit.com). Your purchase, its payment, any subscription or renewal and any refund are also subject to BuiltByBit's own terms and refund policy, and to what the resource page states at the time you buy. Where BuiltByBit's terms and these terms deal with the same thing, BuiltByBit's terms govern the purchase and these terms govern the use of the Software and the Service.

A license is issued automatically when BuiltByBit confirms the purchase. We may also issue licenses directly, for example trials, replacements or licenses agreed with you; those follow these terms too, with the duration and limits shown on the license.

Nothing in these terms limits the rights that consumer protection law grants you and that cannot be waived, including those under Chile's Law 19.496 and the law of the country where you live.

3. Your license

Each license gives you a personal, non-exclusive, non-transferable and revocable right to install and run the products it covers on the Minecraft servers that you own or operate, for as long as the license is valid. Specifically:

• One license covers one person or one server network (a group of servers run together under one brand or administration). It may not be shared between networks owned or run by different people.
• The number of servers (IP addresses) and machines (hardware identifiers) a license may run on is the limit shown on the license in the panel. You can free a slot from the panel or the bot when you move to another server or machine.
• A license with an expiry date, such as a trial or a time-limited license, ends on that date. Other licenses do not expire, but remain subject to these terms.
• Your license key and the loader issued for you are personal and confidential. You are responsible for their use, and you should rotate the key from the panel if you believe it has leaked.
• The license covers the updates we publish for the product while we maintain it. It does not oblige us to keep developing a product, to add features or to support every Minecraft or server version.

The Software is licensed, not sold. We, or our licensors, keep all rights in it, including its code, assets and brand.

4. What you may not do

Unless we agree otherwise in writing, you must not:

• Share, publish, upload, give away, rent, lend, sell or resell the Software, the loaders, your license key or access to them, including in "leak" sites, bundles, server setups or hosting offers.
• Use a license on more servers or machines than it allows, or on servers of a different network.
• Remove, bypass, disable, emulate or tamper with the license check, the loader or any other protection, or help anyone else do so.
• Decompile, disassemble, reverse engineer or modify the Software or the loaders, except to the extent the law expressly allows it despite this restriction.
• Remove copyright notices or present the Software as your own.
• Use the Service to access licenses or accounts that are not yours, automate it in a way that overloads it, or probe or attack it, except in coordinated security research agreed with us in writing.

You may configure the Software, translate its messages and build integrations with its public API for your own servers.

5. Suspension and revocation of licenses

We may suspend or revoke a license, and close the related account, if:

• The payment is reversed, disputed or charged back, or the purchase is refunded.
• The license key, the loader or the Software is shared, leaked or resold, or the license is used beyond its limits.
• You bypass or attempt to bypass the license check or any protection, or otherwise breach section 4.
• The purchase was made fraudulently or with someone else's payment method or account.
• We are required to do so by law or by a competent authority.

A suspended license stops working on the next start of the server. Where reasonable we will warn you first and give you a chance to explain or fix the problem, for example when a limit was exceeded by mistake. If a suspension turns out to be unjustified, we will restore the license. A license revoked because of a chargeback may be restored once the dispute is resolved in our favour or the payment is completed.

We may also replace a license key, for example when it has leaked; the new key is shown in the panel and the bot.

6. The panel and the bot

You sign in with Discord. You are responsible for keeping your Discord account secure and for everything done through your session or your Discord account in the bot.

The Service matches your Discord account with your purchases automatically, from the Discord account linked on your BuiltByBit profile or on your customer record. When a match is uncertain, it is reviewed by a person; you can also link your account yourself with a license key. Do not link, or try to link, licenses that are not yours.

The Service is provided free of charge to buyers of the Software. We may add, change or remove features of the panel and the bot. The Service depends on third parties such as Discord, Lukittu, BuiltByBit and Cloudflare, whose own terms apply to your use of them.

Exylia is not an official Minecraft product and is not approved by or associated with Mojang or Microsoft. It is not affiliated with Discord, BuiltByBit, Lukittu or Cloudflare.

7. No warranty

We work to keep the Software and the Service working well, but, to the extent the law allows, we provide them "as is" and "as available". We do not guarantee that they will be uninterrupted or error-free, that they will work with every server, plugin or version, or that they will meet a particular purpose. Keep backups of your servers and test updates before using them in production.

The license check needs to reach Lukittu when the server starts. We are not responsible for a server that cannot start a plugin because of an outage of Lukittu, your host or your network, although we will help you as best we can.

8. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential damages, loss of profits, revenue, players, data or reputation, or for damages caused by third-party services, by other plugins or by your own configuration. Our total liability for any claim related to the Software or the Service is limited to the amount you paid for the license concerned in the 12 months before the claim or, if you paid nothing, to 100 US dollars.

Nothing in these terms limits liability that cannot be limited by law, such as for intent or gross negligence, nor the rights that consumer protection law grants you.

You will hold us harmless from claims by third parties arising from your breach of these terms, in particular from sharing, reselling or tampering with the Software.

9. Changes, law and contact

We may update these terms. We will show the date of the latest version at the top and announce material changes in the panel at least 30 days before they apply. Changes do not reduce the scope of a license you already bought. If you keep using the Service after that, you accept the new terms.

These terms are governed by the laws of the Republic of Chile. Disputes will be submitted to the ordinary courts of Santiago, Chile, without prejudice to the mandatory rights and forum that consumer or data protection law in your country may grant you.
